The article describes the (disastrous) consequences – practical and legal – of one of the most frequent errors made by data controllers dealing with privacy rules: the use of default consent as the legal basis for processing, regardless of any assessment on its actual adequacy to the specific case.

Maria Roberta Perugini addressed the issue of identifying the correct legal basis in the context of personal data processing, focusing in particular on the consequences of the improper use of consent. For the sake of clarity, the article examines the emblematic case of improper use of consent for the processing of personal data for the purpose of executing a contract (concluded by the data subject).
